Heard. The composition is accepted and permission is granted for composition under Section 320(6) Cr.PC. Crl.R.P.No.801 of 2014.
Conviction and sentence under Section 138 of Negotiable Instruments Act are under challenge in this revision. Pending the proceedings the parties settled the dispute amicably out of court and compounded the offence. The composition filed by the parties was accepted and permission for composition was granted on Crl.M.A.No.2749 of 2014. Accordingly, the conviction and sentence against the petitioner under Section 138 of NI Act in CC.No.2478/2009 of the Judicial First Class Magistrate Court-II, Thrissur are set aside and the petitioner/accused is Crl.M.A.No.2749/2014 & Crl.R.P.No.801/2014 2 released from prosecution on the benefit of acquittal under Section 320(8) Cr.PC. The bail bond executed by the petitioner will stand discharged. The revision petitioner is permitted to withdraw the amount of Rs.75,000/- (Rupees seventy five thousand only) deposited by him in the Court of Sessions, Thrissur as per Order in Crl.MP.No.1173/2011.
This Crl.RP is allowed as above.
