The prayer in the present petition is to issue direction to the first appellate court to decide the Civil Appeal No.64 of 2011 (Dr. Sahib @ Surendra Singh v. Ram Ratan). By bringing the order dated 17.1.2019 in petition No.32 of 2019 (Anil Kumar Pandey v. Dr. Sahib @ Surendra Singh & Anr.), it is submitted by learned counsel for the petitioner that a direction has already been given by this Court for early disposal of the connected Civil Appeal No.59 of 2011 (Doctor Sahib @ Surendra Singh Vs. Ram Ratan & others).
In view thereof, having perused the order sheet, without expressing any opinion as to the merits of the claim made by the petitioner, the present petition is being disposed of with the direction to the Additional District Judge, Court No.8, Kanpur Nagar to decide the Civil Appeal No.64 of 2011 (Dr. Sahib @ Surendra Singh v. Ram Ratan), expeditiously, preferably within a period of six months from the date of submission of certified copy of this order without granting any unnecessary adjournment to any of the parties.
