List has been revised. None appears on behalf of the petitioner even though the learned Standing counsel for the respondents is present.
This writ petition has been filed , inter alia, for the following relief:
" Issue a Writ, order or direction in the nature of Certiorari quashing the impugned recovery certificate dated 22.12.2003 issued by respondent no. 2 and Citation dated 13.1.2004, issued by Tahsildar Chibramau, Kannauj (Annexure no. IV-A & V to the writ petition)."
From perusal of the record and also the averments made in para- 2 of the supplementary affidavit, it transpires that in compliance of the interim order of this court dated 24.2.2004, the petitioner has already deposited a sum of Rs. 2,52,000/- out of the alleged due amount of Rs. 3,44,400/- as mentioned in the impugned recovery certificate dated 22.12.2003.
In view of the above payment made by the petitioner in compliance of the interim order, earlier passed by this court on 24.2.2004, the writ petition stands allowed. It is made clear that the respondents shall not claim any further amount in pursuance of the impugned recovery certificate or any other certificate issued subsequent thereto, in respect of grant of the concerned Theka for collection of Toll Tax of Pantoon Bridge Kulhapur, Kannauj
