A compassionate appointment was offered to petitioner on 9.8.2004. The appointment, however, was allowed fixed pay. According to petitioner, the compassionate appointment offered to him was a substantive appointment and ought not to have been treated on fixed pay. The District Basic Education Officer has also recommended to the Secretary, U.P. Basic Shiksha Parishad on 3.6.2017 with the observation that petitioner be treated to have been regularized against the substantive vacant post. This letter of the District Basic Education Officer has not been considered by respondent no.2, so far.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.2 to examine the letter of District Basic Education Officer dated 3.6.2017, in accordance with law, within a period of four months from the date of presentation of certified copy of this order.
