1. The petitioners are working as Assistant Teachers in Government Inter Colleges in the State. They have come to State of U.P. after The U.P. Reorganisation Act, 2000. Seniority of the petitioners vis-a-vis other Assistant Teachers in Government Colleges who were working in the State of U.P. when the petitioners came and joined the services as a result of U.P. Reorganisation Act, 2000 has been determined by Additional Director (Higher Secondary Education). However, the aforesaid seniority is subject to the final decision to be taken by Additional Chief Secretary (Higher Secondary Education).
2. Learned counsel for the petitioners submits that in respect of employees of some other departments, the Additional Chief Secretary (Secondary Education) has taken the decision. He further submits that the Government Policy dated 09.11.2017 in this respect is very clear and unambiguous and decision can be taken within no time in accordance with the aforesaid policy of the Government.
3. Be that as it may, the Additional Chief Secretary (Higher Secondary Education) is directed to take decision in respect of seniority of the petitioners keeping in view the policy decision of the Government dated 9/14.11.2014 within a period of three months. Once the decision is taken by the Additional Chief Secretary (Higher Secondary Education), the Seniority determined by the Additional Director (Higher Secondary Education) will be revisited and rearranged accordingly.
4. With the aforesaid observations, the writ petition is finally disposed of.
