The proceedings to determine the correctness of the list of members of the general body of the society registered under the name and style of Jain Shiksha Samiti, Sikandarabad, Bulandshahar is pending consideration before the respondent No.2-Deputy Registrar, Firms, Societies and Chits, Meerut. The consideration has to be made in terms of Section 4(b)(1) of the Societies Registration Act.
Contention of Sri Pankaj Kumar Srivastava, learned counsel for the petitioner is that the aforesaid proceedings under Section 4(b)(1) of the U.P. Societies Registration Act may be completed within a stipulated period of time.
The Learned Standing Counsel has no serious objection to the aforesaid prayer.
The matter is remitted back to the respondent No.2-Deputy Registrar, Firms, Societies and Chits, Meerut.
A writ of mandamus is issued commanding the respondent No.2-Deputy Registrar, Firms, Societies and Chits, Meerut to complete the determination of the members of the general body in accordance with the provisions of Section 4(b)(1) of the U.P. Societies Registration Act, preferably, within a period of three months from the date of receipt of a certified copy of this order. Before passing any order or completing the exercise under Section 4(b)(1) of the U.P. Socieities Registration Act, the respondent No.2-Deputy Registrar, Firms, Societies and Chits, Meerut shall give an opportunity of hearing to the respondent No.4 and any other necessary parties as it deems fit.
With the aforesaid direction, the writ petition is finally disposed off.
