Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to stay the order of Non-Bailable Warrant dated 21.05.2018 passed by Judicial Magistrate, Bahedi, District Bareilly in Complaint Case No. 321 of 2016 (M/s Bismillah Rice Mill Vs. Gagandeep Kaur & Others) under Section- 138 N.I. Act & 420 I.P.C., Police Station- Devraniya, District- Bareilly, pending in the court of Judicial Magistrate, Bahedi, District-Bareilly.
Undisputedly, the applicant had challenged the summoning order by means of Application 482 No.37373 of 2016. The same had been initially entertained and it was dismissed vide order dated 20.07.2017, whereby the interim order had been vacated. The applicant has yet not appeared before the learned court below and has challenged the non bailable warrant issued as a consequence of non appearance. No interference is warranted at this stage.
Accordingly, the present application is dismissed.
