Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Sanjay Kumar Pachori,J.
Heard learned counsel for the petitioner and learned Additional Chief Standing Counsel.
The petitioner is before this Court for a direction to respondent no.2 to decide the representation dated 19.10.2019 within stipulated period.
It appears from the record that twice the petitioner has invoked the jurisdiction under Article 226 of the Constitution of India and on both the occasions the Court has intervened and accorded the relief to the petitioner.
Earlier the aunty of the petitioner invoked the remedy under Article 226 of the Constitution of India and filed a writ petition being Civil Misc. Writ Petition No.37661 of 1994 (Smt. Shakuntla Devi Vs. State of U.P. and others) and the same was disposed of on 24.11.1994.
Thereafter the petitioner approached this Court by preferring Writ-C No.-5149 of 2016 (Anil Kumar Gupta @ Guddu Banarsi Vs. State of U.P. and 2 Others.) and the writ petition was disposed of on 10.2.2016.
Learned Additional Chief Standing Counsel fairly states that he has no objection in case, the petitioner files a fresh representation before the competent authority for redressal of his grievances.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the writ petition stands disposed of with observation that in case the petitioner makes fresh representation to respondent no.2 ventilating his grievance within two weeks, the authority would decide the same in accordance with law in further six weeks.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
