This petition has been filed by the defendant-tenant praying to set aside the order dated 08.07.2019, whereby the application 38 Ga in P.A. Case No.9 of 2012 was rejected by the Prescribed Authority/Civil Judge (S.D.) Etawah.
Prima facie, this petition appears to be frivolous.
After arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the petition and, therefore, it may be dismissed as withdrawn and a direction may be issued to the concerned court below to decide the aforesaid P.A. Case No.9 of 2012 within four months without granting any unnecessary adjournment to either of the parties.
Considering the aforenoted submissions, this petition is dismissed. It is directed that the concerned court below shall decide P.A. Case No.9 of 2012 in accordance with law, expeditiously, preferably within four months, without granting any unnecessary adjournment to either of the parties. If under any circumstances an adjournment is granted then it shall be granted subject to payment of cost of not less than Rs. 2000/- and for a period not exceeding seven days.
In view of the above, writ petition is dismissed as withdrawn.
