Heard learned counsel for the petitioner and Sri Sunil Kumar Misra, learned counsel representing the Corporation.
The petitioner challenges the order dated 03 March 2021 pursuant to which his claim for promotion and his complaint that juniors had been promoted, has been rejected. The order records that in terms of the final seniority list which was prepared, a promotional exercise was initiated by the respondents for considering the case of Conductors being promoted to the post of Booking Clerk. The order records that the last promoted candidate stood at serial no.52 in the seniority list whereas the petitioner's name appears at serial no.105.
Learned counsel for the petitioner was unable to draw the attention of the Court to any employee whose name found place below him who may have been accorded promotion. Although it was contended that the respondents have been wrongly promoted, it was candidly admitted that the employees mentioned at serial nos.24 to 26 of the final promotion order dated 25 June 2020 stood placed above the petitioner in the final seniority list. It is also conceded that the petitioner had never challenged the seniority list in accordance with law. In view of the aforesaid, the Court finds no ground to interfere with the order impugned.
Accordingly, the petition stands dismissed.
