The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the order dated 02.11.2020 passed in Writ C No.15346 of 2020 (Anil Kumar Chaubey Vs. State of U.P. and 3 Others).
Today when the matter is taken up, an affidavit of compliance has been filed by the Jagannath Maurya, learned counsel appearing on behalf of opposite party. In paragraph-5 of the compliance affidavit it is stated that appeal of the applicant has already been decided by the appellate court namely Principal Secretary, Consumer Forum & Weight Measurement Anubhag- 3, Government of U.P., Lucknow vide order dated 02.06.2021, copy of the order is appended as Annexure-1 to the affidavit of compliance. Since order has already been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is dismissed as infructuous.
