Heard counsel for the petitioner and learned standing counsel appearing for the State respondents.
By means of the present petition under Art. 226 of the Constitution, seeks a direction in the nature of mandamus commanding the District Magistrate, Hapur- respondent no. 3 to appoint a receiver to manage the affairs of the committee of management of the society namely Sri Ram Leela Samiti, Hapur and a further direction to the said respondent no. 3 to decide the petitioner's representation, within some specified period.
Contention of the learned counsel for petitioner is that term of the committee of management of the society namely Sri Ram Leela Samiti, Hapur has already expired on 15.9.2018 but no efforts were made by the committee of management to hold the election. Consequently, the Deputy Registrar,Firms,Societies and Chits, Meerut wrote a letter dated 26.9.2018 (Annexure-4) to the District Magistrate for holding election immediately as nobody is managing the affairs of the said society but till date nothing has been done at the instance of the District Magistrate. The petitioner, who himself claims to be a life member of the society, has also filed a representation dated 14.9.2019 (Annexure-10) in this regard to the District Magistrate,Hapur and grievance of the petitioner is that nothing has been done on his representation as well.
After hearing learned counsel for the petitioner and learned standing counsel, the present writ petition is being finally disposed of by issuing a direction to respondent no. 3-District Magistrate, Hapur to look into the grievance of the petitioner as detailed in his representation dated 14.9.2019 and ensure holding of the election of the society namely Sri Ram Leela Samiti, Hapur, in accordance with law as expeditiously as possible within 4 months from the date of production of a certified copy of this order. No order as to costs.
