Heard Sri Mayank Singh, learned Advocate holding brief of Sri Bhanu Bhushan Jauhari, learned counsel for the petitioner and perused the record.
This petition has been filed questioning the order dated 1st September, 2005, whereby rate of interest is determined as 18%. Since from the first date when the matter was presented before this Court, learned counsel for the petitioner did not appear and the case was directed to be listed in ordinary course, and now the matter has been listed after more than one and half decade, learned counsel for the petitioner is not able to state as to whether order impugned has been carried out and cause still survives or not.
In the considered opinion of the Court, since the matter has not been heard since last one and half decade, the matter has been rendered infructuous due to efflux of time.
Under the circumstances, this petition is dismissed as infructuous.
