Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. respondent no. 1-Judge Small Cause Court, Kanpur Nagar be directed to expedite the hearing and decide the SCC Suit No. 141 of 2012 (Anil Chokhani vs. Jagdish Prasad) within a time bound period.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1-Judge Small Cause Court, Kanpur Nagar to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously, preferably within a period of one year by giving short dates provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
