JUDGMENT / ORDER

Court No. - 69
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 56278 of 2019 Applicant :- Anish Opposite Party :- State of U.P.
Counsel for Applicant :- Kamini Pandey (Dubey),Anand Kumar Pandey Counsel for Opposite Party :- G.A.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A for the State and perused the record.
The instant bail application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicant in Case Crime No. 275 of 2019, under Sections 3,5,8 of the Cow Slaughter Act, 1955; Section 11 of the Prevention of Cruelty to Animals Act, 1960 and Sections 307, 420, 467, 471 of I.P.C., Police Station Baldev, District- Mathura.
The Court finds itself unable to countenance the prayer for grant of anticipatory bail since as per the F.I.R. allegations, the driver of the truck who was apprehended on the spot has identified the applicant as the owner of the vehicle which was being used for transporting cattle. The police party further found out that different numbers were placed on the front and back of the truck in question. Although the number displayed on the front of the truck was registered, according to the applicant, in the name of one Saddam no explanation has been proffered with respect to a different number plate appearing and being fixed on the back of the truck. It is also not the case of the applicant that the second registration number which is referred to in the F.I.R. has no connect with the applicant here. In view thereof, the prayer for grant of anticipatory bail cannot be countenanced and is refused.
The Bail Application is consequently rejected.
