The petitioners have approached this Court seeking for a direction to respondents 1 to 3 to stop construction of a culvert and for other consequential reliefs. 2. The facts involved in the case would disclose that the construction of a culvert by respondents 1 to 3 at the entry of a road to the Industrial Development Area (IDA), South Angamaly, according to the petitioners, would prevent movement of heavy vehicles and it will also obstruct free flow of water.

The 3rd respondent has filed a statement inter alia stating that construction of the culvert is going on and 57% of the work has been completed by giving sufficient slope for the easy entry of heavy vehicles and Industrial Development Area Authorities are satisfied with the work. It is further stated that the culvert will be completed without causing any hindrance for the movement of the heavy vehicles and sufficient arrangements will be made for the flow of rain water through the culvert by connecting the same to the existing drain.
4. Counter affidavit is filed by the 4th respondent inter alia stating that the culvert in question is constructed as a part of the development work. Now slopes were W.P(C) No. 26907 of 2014 -: 2 :-
provided on either side of the culvert so as to reduce the height difference. The 3rd respondent has assured that the level difference will be further reduced on completion of the tarring work.

Having regard to the aforesaid factual situation and since the respondents have clearly indicated that when the road work is completed the apprehension expressed by the petitioners will be over and that necessary provision will be made for draining rain water through the said culvert, I do not think that any further directions are required to be issued.
Taking on record the averments made by the authorities, this writ petition is disposed of.
