2. Mrs.Jayalakshmi ... Respondent/Defacto Complainant Criminal Original Petition has been filed under Section 482 Cr.P.C. to call for the records and quash the first information report registered by the first respondent in Crime No.212 of 2016.
For Petitioners : Mr.K.G.Senthilkumar For Respondent-1 : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed by the petitioner seeking to quash the first information in Crime No.212 of 2016 pending on the file of the first respondent.
2. A complaint has been lodged by the defacto complainant/ the second respondent herein on 31.07.2016 before the first respondent police against the petitioner and a case came to be registered for an offence under Sections 147, 148, 448, 294(b), 323, 324, 506(ii) of IPC r/w Section 4 of Women Harassment Act, 2002 and to quash the FIR the petitioner has filed the present quash petition.
3. Today when the matter is taken up for hearing, Mrs.Jayalakshmi, defacto complainant/second respondent herein was present in Court and she had filed an affidavit to the effect that based on the advise given by the elder members of the family and the village Panchayatars and the petitioner had also tendered his apology for the act committed by him, she had decided to resolve the issue. It is further stated in the affidavit that in order to maintain cordial relationship with the petitioner, who belongs to the same village and to purchase peace, she had decided to settle the matter and submitted that the First Information Report may be quashed.
4. Heard the learned counsel for the parties and perused the affidavit filed by the second respondent/defacto complainant.
5. Taking into consideration the fact that the parties are ready to settle the dispute amicably in order to maintain cordial relationship and to purchase peace, no useful purpose would be served by proceeding with the case. Considering the submissions made and in order to meet the ends of justice, the proceedings in Crime No.212 of 2016 is hereby quashed. The present criminal original petition is allowed.
