Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 8.1.2019 registered as Case Crime No. 14 of 2019, under Sections 272, 273 I.P.C., and 60, 63 Excise Act, P.S. Gulariha, District Gorakhpur.
The allegations in the first information report is with regard to preparing adulterated liquor, which has been recovered with various adulterants and equipments.
It has been stated that the petitioner escaped from the spot. However, his complicity is disclosed in the statement of co-accused.
Considering the nature of the allegations, no case for interference is made out.
The petition is dismissed. The petitioner is at liberty to apply for bail.
