Heard learned counsel for the applicants and learned A.G.A. for the State as also perused the record.
The present 482 Cr.P.C. application has been filed to quash the order dated 16.05.2018 passed by the Judicial Magistrate, Kushinagar at Padrauna in Criminal Misc. Application No. 433 of 2018 (Hari Shankar Chauhan Vs. Lavkush and others) under Section 156 (3) Cr.P.C.
Sri Sanjay Kumar Singh, learned AGA upon instruction received has submitted that while it is true that same FIR were earlier lodged against the applicants no other/further FIR has yet been lodged in pursuance of the order impugned in the present application.
In light of that preliminary objection raised, the present application is not maintainable, inasmuch as all remedies would remain open to the applicants, as and when any FIR is lodged.
Considering the above, no interference is warranted at this stage. The present application is accordingly dismissed.
