Heard Sri Ram Mani Upadhyay, learned counsel for the petitioner and learned Standing Counsel for the State.
The petitioner has challenged the order cancelling his fair price shop during the pendency of the appeal preferred by hims against his suspension of the fair price shop.
The order impugned dated 15.1.2018 goes to show that without record orders are passed hence, order dated 15.1.2018 relating to cancellation is prima facie stayed as without record the order could not have been passed.
The petitioner within four weeks from today, shall move the appellate authority where his appeal is pending and the appellate authority shall consider the petition as well as the memo of appeal as part of the earlier appeal and decide even the stay application along with the appeal preferred by the petitioner.
With these observations, this petition stands disposed off.
