Heard learned counsel for the petitioner and Sri Abhishek Shukla, learned Standing Counsel appearing for the respondents.
This writ petition has been filed seeking a direction to the respondent no. 2 to decide Case No. 46/281 of 2010, Smt. Aneeta Devi V s. Smt. Sukhau under Section 34 of the L.R. Act pending in the court of the Naib- Tehsildar, Tehsil Handia, district Allahabad within a stipulated time.
Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, the respondent no. 2, the Naib- Tehsildar, Tehsil Handia, district Allahabad is directed to decide the aforesaid case, as expeditiously as possible, preferably within three months, in accordance with law, without granting any unnecessary adjournments and giving short dates provided there is no other legal impediment.
A reference may also be made to the judgments of this Court in the cases of Chandra Bali vs. Additional Commissioner and others, 2012 (4) ADJ 13 and Radha Devi vs. State of U.P. and others, 2016 (6) ADJ 753 wherein directions for time bound disposal of such cases have been given and provisions of U.P. Janhit Guarantee Adhiniyam, 2011 have been considered.
With the aforesaid observations, present writ petition stands disposed of.
