This writ petition has been filed praying for a direction commanding the respondent no. 2 not to arrest the petitioner in the F.I.R. dated 16.11.2020 lodged by respondent no. 3 as Case Crime No. 535 of 2020, u/s 147, 148, 323, 325, 307, 352 IPC, P.S. Jevar, District Gautam Budh Nagar.
At the very outset, learned AGA submits that in the present case crime, charge-sheet has already been submitted against co- accused and the investigation is on qua to the petitioner.
Learned counsel for the complainant states that so far as the petitioner, he has already preferred anticipatory bail before this Court, which has been rejected.
In the facts and circumstances, once the Court has declined to intefere, learned counsel for the petitioner fairly states that he does not to press the present writ petition and the same may be dismissed as not pressed with the liberty to seek appropriate remedy as available in law.
Consequently, the writ petition stands dismissed as not pressed with the liberty to invoke the remedy as available in law.
