Heard Sri K N Dubey, Advocate holding brief of Sri Satish Chandra Dubey, learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed seeking the direction to expedite the proceedings of Session Trial No. 1241 of 2010 (State Vs. Rajkumar & Ors.;) arising out of Case Crime No. 290 of 2010, under Sections 304/34 I.P.C. and 27/30 Arms Act, Police Station-Katghar, District-Moradabad.
Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant.
In the facts and circumstances of the case the lower court concerned is directed to expedite and conclude the proceeding of the aforesaid case within a period of six months from the date of production of a certified/computer generated copy of this order before him, without granting any unnecessary adjournment to either of the parties, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case.
With the aforesaid observation, this application is disposed of finally.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad or certified copy issued from the Registry of the High Court, Allahabad.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
