JUDGMENT / ORDER

Hon'ble Rajeev Singh,J.
Heard learned counsel for the petitioner and Sri H.P. Srivastava, learned additional chief standing counsel for the State through video conferencing.
By means of this writ petition, the petitioner has prayed for a writ of mandamus commanding the opposite party no.3 i.e. Election Officer to take a decision on the application/objection filed by the petitioner on 09.04.2021 as was received in his office on the same date.
It appears that the objections have been raised as regards entertaining the nomination of opposite party no.4 who is alleged to have used a forged adhar card in the ensuing panchayat election. The election is scheduled to be held on 19.04.2021.
All these questions are open to be raised in an election petition at an appropriate stage.
This Court in exercise of writ jurisdiction may not be right to entertain such disputed question of fact at this stage particularly when the election is scheduled to be held of 19.04.2021. The decision taken by the Election Officer on the objections, if any, may be communicated to the petitioner so that he may be enabled to avail the remedy open to him under law.
The writ petition is accordingly disposed of.
