The suit for realisation of money has already been listed for trial. The application for attachment before judgment has been dismissed by the impugned order. The court below has dismissed the application for the reason that there is no satisfactory evidence to show that the respondent is attempting to alienate the property. 2. The respondent undertakes that he will not sell the property sought to be attached till the suit is disposed of. This undertaking is recorded and no further order of attachment is necessary therefore.
3. I direct the court of the Subordinate Judge of Thiruvalla to dispose of O.S.No.97/2012 at the earliest. Every endeavour shall be made to dispose of the suit within a period of four months from the date of production of this judgment.
The Original Petition is disposed of.
