JUDGMENT / ORDER

A prosecution involving the offence under Section 420 IPC is sought to be quashed under Section 482 Cr.P.C. The offence under Section 420 IPC is compoundable under the law with permission. When an offence is compoundable under the law with permission or without permission, the parties will have to approach the trial court for composition. I do not think that the trial court will deny permission when the parties have come to terms amicably out of court. Without prejudice to the right of the parties to approach the trial court for composition of offence, this Crl.M.C. is closed.
