JUDGMENT / ORDER

Heard Sri.P.M.Habeeb, the learned counsel for the petitioner and Sri.Tom Jose Padinjarekkara, the Additional D.G. of Prosecutions-cum-Additional Public Prosecutor appearing for the respondent-State of Kerala. Arguments went on for some time and the Additional Prosecutor was requested by this Court to file a statement containing the factual particulars of the matter so as to enable the court to take a considered decision in the matter. Both sides have also cited certain decisions of this Court and that of the Apex Court. After arguing for some time, Sri.P.M.Habeeb, learned counsel for the petitioner submits that the petitioner may be given leave to withdraw this Criminal Miscellaneous Case reserving his contentions and right to invoke appropriate remedies in accordance with law. Leave granted. The Criminal Miscellaneous Case is dismissed as withdrawn.
