JUDGMENT: (per the Hon'ble Sri Justice L. Narasimha Reddy)
Respondent Nos.1 to 8 herein (for short ‘the respondents’) are the employees who retired from various organisations. They have been engaged on contract basis as Special Officers by the appellant. The respondents filed Writ Petition No. 12312 of 2014 complaining that they are likely to be relieved in the month of April, 2014. Their contention was two fold. The first is that they are entitled to be continued till the end of the academic year and secondly, the Government issued G.O.Ms.No. 84, dated 17-04-
2014 providing for continuance of contractual employees till the end of June of the concerned year. Taking note of the same, the learned single Judge passed an interim order on 01-0-42014 while issuing notice before admission. The said order is challenged in this writ appeal.
Heard the learned counsel for the appellant and the learned counsel for the respondents.
The learned single Judge took note of the proceedings dated 09-04-2014 issued by the appellant – Society on the one hand and G.O.Ms.No.84 on the other hand. The purport of the proceedings dated 09-04-2014 is that the employees who are working on deputation basis in the Society must be repatriated to their parental organisations. G.O.Ms.No. 84 is to the effect that the employees who are working on contractual basis will be continued till 30-06-2014 in view of reorganisation of the State. The respondents do not fit into any of those proceedings. They are purely engaged on contract basis and they do not have even a semblance of right to continue beyond the period mentioned in the contracts. Though they are retired employees, they sought to draw parity with the unemployed persons who are engaged on contract basis. They are not entitled to any such benefits. At any rate, the interim order passed by the learned single Judge worked out itself.
With the above observations, the writ appeal is disposed of. The miscellaneous petitions pending in this appeal shall also stand disposed of. There shall be no order as to costs.
