JUDGMENT / ORDER

When the matter was taken up for hearing, learned counsel appearing for the respondent submits that he has got oral instructions to the effect that the appellants, being the tenants, have vacated the suit premises and handed over the possession to the respondent.
2.Learned counsel appearing for the appellants submits that he has no instructions.
3.In view of the abovesaid submission made by the learned counsel for the respondent, this Court is of the view that no useful purpose would be served in keeping the appeal pending. Hence the second appeal is dismissed. However, liberty is given to the appellants to file appropriate application or mention before the Court to restore the appeal, if so advised. No costs. Consequently, connected miscellaneous petition is closed.
