By means of the present petition, the petitioner herein is seeking for quashing of the first information report dated 11.07.2021 registered as Case Crime No.702 of 2021 under Section 302 I.P.C P.S-Murad Nagar District-Ghaziabad on the premise that the petitioner is not named in the FIR.
The contention of the learned counsel for the petitioner that the petitioner is innocent person or he has been harassed by the investigating officer cannot be seen here.
No factual enquiry can be made by this Court within the scope of Article 226 of the Constitution of India to examine the contention of the petitioner that the first information report is malicious in nature.
Any interference, at this stage, may impede the speedy investigation.
