ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents, in not permitting the petitioner to write the internal and general examinations of I semester of IIIrd year B.Tech course, scheduled to commence from the months of November and December, 2014, respectively, as illegal and arbitrary.
The petitioner averred that respondent No.1 has prescribed 30 credits for promotion to the next year and that as he had only 28 credits in the II year of B.Tech course, he is not being permitted to appear for the internal and general examinations of I semester of IIIrd year B.Tech course.
Sri A.Abhisekh Reddy, learned Standing Counsel for respondent No.1-University, on instructions, submitted that as per the Regulations of Jawaharlal Nehru Technological University, a student shall have 34 credits for being promoted to the next year and that as the petitioner has only 28 credits, he is not being permitted to appear for the internal and general examinations of I semester of IIIrd year B.Tech course.
This Court by order, dated 15.10.2014, in Writ Petition No.30706 of 2014 has held that a student cannot legitimately question his detention for not clearing the back logs as per the University Regulations and that no Mandamus can be issued to the University to act contrary to its Regulations. This order was confirmed by a Division Bench of this Court by order, dated 05.11.2014, in Writ Appeal No.1358 of 2014.
In the light of the above legal position, I find no merit in this Writ Petition and the same is, accordingly, dismissed.
As a sequel, WPMP.No.44560 of 2014 is dismissed as infructuous.
