Heard Mr. Bhanu Pratap Singh 'Bisen', learned counsel for the petitioner and Mr. Ajay Kumar Srivastava, learned A.G.A. appearing on behalf of the State through Video Conferencing in view of Covid-19 pandemic.
This petition under Section 482 Cr.P.C. has been filed seeking a direction to the Opposite Party No. 2- District Magistrate, Shravasti to consider and decide the application dated 18.03.2021 for release of the Vehicle/ Tractor-trolley No. UP46K 5678 of the petitioner, pending before it.
Perusal of the record shows that Tractor-trolley of the petitioner was seized and in the inquiry it came to light that the Tractor-trolley was bringing soil and not the sand (Baalu). The copy of the report dated 18.02.2021 is annexed as Annexure No. 4 to the petition. Tractor-trolley of the petitioner was seized on 25.03.2020 and she is suffering because her Tractor-trolley is used for agricultural purpose and there is possibility of damage to the said Tractor-trolley. The petitioner had moved an application dated 18.03.2021 before the District Magistrate, Shravasti for release of her vehicle, which is still pending for disposal.
Learned A.G.A. did not oppose the prayer so made by the learned counsel for the petitioner.
Considering the facts and circumstances of the case, this petition is finally disposed of with a direction to the Opposite Party No. 2- District Magistrate, Shravasti to decide the aforesaid application dated 18.03.2021 of the petitioner expeditiously in accordance with law within a period of two months from the date of production of computerized copy of this order.
