Heard Sri Samarth Singh, learned counsel for the petitioners and Sri Vishnu Kumar, learned Standing Counsel for the State.
Learned counsel for the petitioners submits that petitioners who are washerman by profession have apprehension that conversion of pond no.1238 measuring 0.817 hectares situated in Mauja Baradih, Urf Gambhirpur to a fisheries pond may prevent them from using it as a laundary-bay and injurying their right to livelihood.
Learned counsel for the petitioners fairly submits that as per the provision contained in Rule 57 (15) of U.P. Revenue Code Rules, 2016, there is a provision to protect the rights of the petitioners.
No material has been brought on record to show infringement of the rights which has been protected under Rule 57(15) of the Rules of 2016.
This petition has been filed only on the basis of surmises and conjectures coupled with apprehension. Merely on the basis of apprehension, surmises and conjectures, petition are not maintainable, therefore, for want of actual cause of action, petition is devoid of merits and is dismissed.
