Anandhan vs Sujatha

Madras High Court|22 February, 2017

JUDGMENT / ORDER

The Civil Revision Petition is filed challenging the order dated 07.02.2014 passed in I.A.No.54 of 2013 in G.O.P.No.7 of 2013 on the file of the Additional District Court, Dharmapuri.
2. On examination of the minor boys, the learned Additional District Judge, Dharmapuri had passed an order on 07.02.2014 directing the respondent / mother to visit her two male children in the All Women Police Station, Dharmapuri on every sunday from 10.00 a.m. to 5.00 p.m. Accordingly, directed the petitioner to produce the children on every Sunday to All Women Police Station, Dharmapuri to execute the visitation rights of the respondent / mother.
3. The learned counsel appearing both for the petitioner and the respondent fairly stated that the order had not been implemented in its letter and spirit. Further, the respondent / mother also had not insisted for the execution of the visitation rights.
4. The contention of the learned counsel for the petitioner is that the respondent / mother has not made any serious attempt to visit their children in accordance with the order and no contempt application or any other application is filed in this regard. This fact was not disputed by the learned counsel appearing for the respondent.
5. Such being the factual situation, this Court without expressing any opinion on the merits and demerits of the contentions made out by the respective counsels and considering the fact that it is the case relating to the custody of minor children, is inclined to direct the learned Additional District Judge, Dharmapuri to take up the main case in G.O.P.No.7 of 2013 for final disposal and dispose of the same, as early as possible, preferably within a period of three months from the date of receipt of a copy of this Order. Consequently, connected miscellaneous petition is closed. No costs.
