(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period of 45 days so as to get his mother operated for gynec problem.

Learned APP,Mr.Pujari, waives service of rule on behalf of respondent-State.
Learned APP invited attention of the Court to jail remarks.
Earlier, in the month of May-June, 2012, he was granted temporary bail for a period of 30 days and thereafter, he had moved this Court by filing Criminal Misc. Application No.8271 of 2012 in Criminal Misc. Application No.6917 of 2012 for extension of time. The said application was rejected as the convict, who was present before the Court, could not able to give the name of the Doctor.
Now, the convict has annexed a copy of Certificate dated 14.5.2012 from Dr.Kirit H.Asodiya of Anidip Surgical Hospital and another Certificate dated 15.6.2012 from the same doctor.
Beside, he has also annexed a letter of his younger brother mentioning therein that operation of the mother was scheduled on 19.5.2012 and 25.6.2012 but on account of insufficient funds, the operation could not be undertaken.
Taking into consideration the aforesaid facts, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 (Thirty) days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
