1. The petitioner, the owner of a stage carriage bearing Reg.No.KL-13 J 9978 has applied for re-issue of temporary permit in the route Mundathode - Thalassery - Idumba - Thrikaderipoil in the vacancy of stage carriage bearing Reg.No.KL-13 T 4950 as per Ext.P1. The said vacancy arose because, the permit holder has defaulted its service and had not made any arrangement for continuation of the service.
2. If vacancy of stage carriage bearing registration No. KL 13 T 4950 is still in existence and no other person has applied for a temporary permit to operate a stage carriage in that vacancy, there will be a direction to the respondent to issue a temporary permit of 4 months' duration within three weeks from the date of production of a copy of this judgment by passing appropriate orders on Ext.P1. Needless to W.P.(C)No.30869 of 2014 -:2:-
say, such issuance of temporary permit will be subject to a preferential claim, if any.
Writ petition disposed of as above.
