JUDGMENT / ORDER

Shaffique,J
Petitioner is armed with an order passed by the Chief Engineer, Irrigation (Projects) on 25/4/2014 reiterating an earlier order passed permitting the petitioner to put up a 3 meter pathway at his own cost through the land acquired for an irrigation canal and which remains unused. The complaint of the petitioner was that party respondents 6 and 7 are obstructing the construction of the said pathway and despite the petitioner submitting a complaint to the police, no action has been taken in the matter.
2. Though notice was ordered to respondents 6 and 7 and service is complete, there is no appearance on their behalf.
3. The learned Government Pleader, on instructions, would submit that on the basis of the complaint given by the petitioner as Ext.P17, respondents 6 and 7 were summoned and they had undertaken to the police that they will not cause any obstruction in the construction of the pathway. It is also submitted by the learned Government Pleader that if there is any law and order situation, police will interfere and shall provide necessary protection to the petitioner.
Having regard to the aforesaid submission, this writ petition is disposed of as under:
2nd respondent shall ensure that no law and order situation is created by respondents 6 and 7 or any other person in the construction of pathway by the petitioner in terms with Ext.P13 order issued by the Chief Engineer on 25/04/2014.
