Sri Manoj Kumar, learned counsel for the petitioner, submits that the petitioner undertakes, to make an application for her answer-sheet, in the subject of Mathematics, of the IIIrd Semester, B.T.C. Examination-2018 (Batch-2013), in the prescribed format, after deposit of the requisite fee within a period of 10 days. The only prayer, made by learned counsel for the petitioner, is that the aforesaid representation may be decided, within a stipulated period of time.
Learned Standing Counsel, submits that in case the petitioner, is submitted an application in her prescribed format, after deposit of the requisite fee, and the answer-sheet has not been weeded out as per law, the respondent-authority is under obligation of law, to decide the representation of the petitioner.
In light of the submissions, made by the learned counsel for the parties, the matter is remitted, to the respondent No.2-Secretary, Examination Regulatory Authority, U.P. Allenganj, Prayagraj.
In case the petitioner submits the application, within 10 days, in the prescribed format, after deposit of requisite fee, the respondent No.2-Secretary, Examination Regulatory Authority, U.P. Allenganj, Prayagraj, shall decide the representation of the petitioner to provide a copy of the answer-sheet, in the subject of Mathematics of the IIIrd Semester, B.T.C. Examination-2018 (Batch-2013), within a period of two weeks, from the date of, receipt of, a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions, made in the writ petition, nor the claim of the petitioner has been judged on merits. It is for the competent authority, to do so after independent application of mind, in accordance with law.
With the aforesaid directions, the writ petition is finally disposed off.
