Heard learned counsel for the petitioner and Sri Amit Sinha, learned A.G.A. for the State.
This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair and proper investigation in respect of Case Crime No. 87 of 2019 for the offence under Sections 498-A, 323, 376 of I.P.C. and 3/4 of Dowry Prohibition Act, P.S. Chandpur, District Fatehpur.
According to the petitioner on 9.6.2019 she lodged an FIR against as many as four accused persons but till date the investigation has not been completed nor the charge sheet has been filed. Learned counsel submits that a direction may be issued to the police authorities to investigate the matter fairly and impartially.
State counsel submits that the police authorities are under the obligation to do the investigation fairly and expeditiously and the same would be done in accordance with law.
The present petition is disposed of directing the police authorities to conclude the investigation of the said case expeditiously in accordance with law on the basis of evidence so collected.
Petitioner would be at liberty to sent the copy of this order along with an application to Superintendent of Police, Fatehpur and in eventuality of doing so, the said authority shall look into the matter.
