JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE A.L.DAVE) Rule.
Mr. Kodekar, learned A.P.P., waives service of notice of rule on behalf of respondent - State.
2. The party in person has made this application for temporary release of convict Anak Chapraj Udak for a period of 45 days on the ground of her marriage with the prisoner to be solemnized on 24th and 25th of this month. The prisoner has history of absconding when he has absconded for 784 days in 2006 and surrendered in 2008. But, thereafter, as the jail report would reveal, he has been granted temporary bail thrice and furlough twice where he has surrendered on time.
3. On inquiry being made, it is reported that the cause shown is genuine. In these set of circumstances, we are inclined to entertain this application, in part.
4. Therefore, after considering the averments made in the application and the convict's jail record, the convict is ordered to be released on temporary bail for a period of three weeks from the date of his release, on his executing a personal bond in the sum of Rs.5,000/- (Rupees Five Thousand Only) before the jail authority.
5. Rule is made absolute to the aforesaid extent.
