Mr.R C Kodekar waives service of notice of Rule on behalf of the respondent State.
The applicant seeks temporary bail to attend the after death ceremony of his brother-in-law, who has expired on 10/03/2012. In support of his application, applicant has annexed a death certificate.
Heard learned Additional Public Prosecutor for the respondent - State. The cause shown in the application, is found to be genuine. In this set of circumstances, we are inclined to entertain this application.
The applicant is, therefore, ordered to be released on temporary bail for a period of 01 (ONE) WEEK from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) before the Jail Authorities on certain conditions that he will;
a) not leave the State of Gujarat.
b) not indulge in any illegal activity.
c) surrender before the Jail Authorities in time.
Rule is made absolute.
