JUDGMENT / ORDER

The petitioners are students who have joined the M.Tech course commencing in 2012 and concluding in 2014 under the respondent University. The course is comprised of four semesters. As per the Regulations of the University, the 4th semester examinations can be participated in, only if the candidate clears the 2nd semester examinations. Admittedly, petitioners herein did not qualify in all the papers in the 2nd semester examinations and for the papers in which they failed, they had appeared for the supplementary examinations. Petitioners by the above writ petitions, seek provisional admission to the examinations of the 4th semester subject, however, to the result of the supplementary examinations of the 2nd semester. 2. It is admitted by both sides that the regular 2nd semester examinations were held in August, 2013 and the W.P.(C) No.26489 of 2014 - I 2 supplementary examinations were held a month back. The learned senior counsel appearing for the University would submit on instructions, that the 4th semester examinations have not been notified yet and before notification the Vice Chancellor would definitely take into consideration the hardships projected by the petitioners.

In any event, the issue is covered by the judgment in W.P.(C).3847/2014 dated 10.02.2014 wherein this Court elaborately considered the hardship of the petitioners as also the difficulties faced by the University in publishing the results in time. The remaining issue is insofar as permitting the 4th semester examinations to be participated in, by the students, subject to the result of the 2nd semester supplementary examinations. These directions were issued taking into consideration the fact that this is the first supplementary examination after the regular examinations in the 2nd semester. In any event, the directions in Ext.P15 in W.P.(C). 6349 of 2014 govern the issue. If at all the 4th W.P.(C) No.26489 of 2014 - I 3 semester examinations are notified prior to the publication of the 2nd semester examination results, then, the petitioners shall be provisionally permitted to appear for the examinations subject to the result of the 2nd semester examinations. The 4th semester results shall not be published until and unless the 2nd semester supplementary examinations are published and the publication of the results shall only be of those students who have cleared the 2nd semester examinations in accordance with the University Regulations.
The writ petitions are disposed of.
