Heard learned counsel for the petitioner and Sri Amit Sinha and learned A.G.A. for the State.
This writ petition has been filed by the petitioners seeking quashment of FIR dated 21.7.2019 in respect of Crime No. 100 of 2019 for the offence under Section 8/20 of Narcotics Drugs & Psychotropic Substance Act, P.S. Badausa, District Banda.
Learned counsel for the petitioner after arguing for some time wants to withdraw this petition with liberty to file a regular bail application before the court below. He submits that the court below be directed to decide the bail application of the petitioner on the same day or at least by the next date.
State counsel has no objection insofar as withdrawal of the petition is concerned. He, however, submits that discretion be given to the trial court to decide the bail application in accordance with law.
In view of above, petitioner is permitted to withdraw this petition with the aforesaid liberty.
Needless to state that in the eventuality of filing any regular bail application by the petitioner within four weeks from today before the competent court of jurisdiction, the said court shall decide the same as expeditiously as possible in accordance with law.
It is made clear that this Court has not expressed any opinion on the merits of the case and the competent court to act in accordance with law.
With the above observations, the writ petition is dismissed as withdrawn.
