Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 and 2 and Sri Vikram Bahadur Singh, Advocate holding brief of Sri Bhanu Pratap Singh for respondent no.3.
The mother of the petitioner was working as Class IV employee in Gautam Poorva Madhyamik Vidyalaya, Dharwara, Azamgarh. She has died on 15.09.2017 during the service period. The petitioner, being daughter, has applied for compassionate appointment under U.P. Recruitment of Dependents of Government Servants Dying-In-Harness Rules, 1974 to respondent no.4 on 05.01.2018 and respondent no.3 on 05.03.2019, copies of the same are on record as Annexure 7 and 8 to the writ petition.
The grievance of the petitioner is that till date respondent no.3 has not yet taken any decision on the applications of petitioner for compassionate appointment.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.3-Basic Shiksha Adhikari, Azamgarh raising all her grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of three months thereafter.
With the aforesaid observations, the writ petition is disposed of.
