The petitioner filed O.P No. 745 of 2010 against his wife, the respondent for divorce in the Family Court, Hyderabad. After receipt of summons, the respondent entered appearance and she filed I.A No.126 of 2010 under Section 24 of the Hindu Marriage Act, with a prayer to grant interim maintenance at the rate of Rs.50,000/- per month. The application was opposed by the petitioner. The trial Court allowed the I.A through order dated 01- 06-2012 granting maintenance at the rate of Rs.30,000/- per month from the date of the order payable on or before tenth of every month. The petitioner feels aggrieved by the same.
Heard the learned counsel for the petitioner and the learned counsel for the respondent.
While issuing notice before admission, this Court stayed the operation of the order under revision on condition that the petitioner pays a sum of Rs.15,000/- per month. The said arrangement is continuing during the pendency of the revision. This Court is of the view that the interim maintenance can be restricted to Rs.20,000/- per month. The O.P itself can be required to the disposed of at the earliest.
Hence, the C.R.P is partly allowed reducing the maintenance awarded by the Family Court to Rs.20,000/- per month. The arrears worked out on such basis shall be paid within four weeks from today. The Family Court shall taken up the O.P for hearing and dispose of the same as early as possible.
The miscellaneous petitions filed in this revision shall also stand disposed of. There shall be no order as to costs.
