Heard Sri Namit Srivastava, learned counsel for the petitioner and Sri N.K. Verma, learned AGA for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for direction to respondent no.1 to complete the investigation of case crime no.387 of 2017, u/s 354(A), 354(B), 506 IPC, 3/4 POCSO Act and 3(1)(10) SC/ST (Prevention of Atrocities) Act, P.S. Patiyali, district Kasganj by any independent agency like C.B.C.I.D or C.B.I to conduct the investigation in a fair and proper manner.
Learned AGA has raised preliminary objection that the petitioner who is the informant of the case had earlier approached this Court by filing Criminal Misc. Writ Petition No.28367 of 2017 which was disposed of by coordinate Bench of this Court on 20.12.2017. It is stated that the investigation of the case has not been completed and she has come up before this Court with the prayer to conclude the investigation by any independent agency like C.B.C.I.D or C.B.I.
After having very carefully examined the submissions advanced by learned counsel for the parties and perused the record, we are not inclined to interference in the matter as the petitioners have already approached this Court by filing the aforesaid petition which has already been disposed of by coordinate Bench of this Court.
The petition lacks merit and is, accordingly, dismissed.
After the aforesaid order was passed, learned counsel for the petitioner prays that the present petition be dismissed as not pressed. The said prayer is also rejected.
