Heard Sri Sanjay Kumar Om, learned counsel for the petitioner and Ms. Akansha Sharma, learned Standing Counsel for the State.
The grievance of the petitioner is that he has made construction in accordance with law. However, the apprehension of the petitioner is that the construction made by him may be demolished.
Undisputedly, till date no order has been passed by any of the authority. Stay is operating in favour of the petitioner since 6th March, 2009.
Considering the facts and circumstances of the case, this petition is disposed of permitting the competent authority to take appropriate action against the petitioner, if required, strictly in accordance with law after affording due opportunity to the petitioner.
The petition is disposed of accordingly.
