Heard Sri Agnihotri Kumar Tripathi, learned counsel for the petitioner, Sri R.K. Pandey, learned counsel for the respondent nos. 2, 3 and 4 and learned standing counsel for respondent no. 1.
The petitioner, in the writ petition, is seeking quashing of the demand notice dated 21.12.2018; whereby, she has been directed to deposit a sum of Rs. 9,16,457/-, including sub-divisional charges of Rs. 5,88,297/-.
It is informed that with regard to sub-divisional charges, matter is pending consideration before the Supreme Court in Special Leave to Appeal No. 20258 of 2018 wherein the Supreme Court has been pleased to pass the following order on 13.8.2018.
"Issue notice.
There shall be stay on sub-division charges from the petitioner; however, we make it clear that in case the petitioner is ultimately found liable, he shall be liable to pay the same, with interest, as may be determined at the time of final order."
In this view of the matter, we direct that subject to the petitioner depositing the remaining amount as raised in the demand notice, other than the sub-divisional charges of Rs. 5,88,297/-, the respondent authorities shall sanction the map of the petitioner forthwith.
List for further hearing after disposal of the Special Leave Petition in the Supreme Court.
The respondents may file counter affidavit within four weeks.
