Anand vs National

High Court Of Gujarat|26 June, 2012

JUDGMENT / ORDER

1. This matter has been listed before this Court time and again. Mr. Champaneri, learned advocate appearing for the respondents no. 1 & 2 had not remained present on earlier occasions inspite of several adjournments and finally the matter is taken up today.
2. Today, Mr. Champaneri states that he no more appears for the respondents no. 1 & 2 in this matter. No reply has been filed by the respondents till date nor the respondents have been represented by any advocate before this court. The averments made in the petition, therefore, have not been rebutted. It appears that the respondents are trying to avoid this court. If the interim relief is not granted at this stage the petition shall become infructuous.
3. Hence, interim relief in terms of para 31(D), (DD) & (E) is granted subject to the result of the petition.
Direct service is permitted by way of RPAD.
