Order under challenge in the present writ petition is merely a consequence of a previous order passed by the District Magistrate, Basti dated 11.6.2013. Order dated 11.6.2013 is subjudice before this Court in Writ Petition No. 34453 of 2013. It appears that initially an interim order was passed in the writ petition but the same was not extended. Stay extension application is pending. The authorities have proceeded to implement the order of 2013, now, by the order impugned.
In the facts and circumstances, noticed above, remedy of the petitioner would be to press his stay extension application in the pending writ. A fresh writ petition would not lie in respect of consequential action, particularly when the main writ petition remains pending.
Leaving it open for the petitioner to pursue his pending writ petition and to seek appropriate remedy therein, this petition is consigned to records.
